Patriot Act I, II and the Victory Act - Bad Legislation!

March 17, 2003 Socorro, New Mexico, 8,877 people who live there had a relatively uneventful small town day, but it was a day Socorro City stood up to be counted. On that beautiful Spring day Socorro City affirmed its deep faith in our cherished institutions of human rights and our Constitution by passing a Resolution to affirm the Bill of Rights and stand down from involvement in the evils of Federal Centrism and fascism, some call it outright tyranny, disrespect at the very least for the great wisdom of our forefathers. Now in September of 2003 many in the county and in Valencia County to the north are moved to do the same thing.
To date 332 communities have defied the Patriot Act and any follow-on acts such as Patriot II granting excessive power to Ashcroft's Christian Zionist Renegade Army. It is obvious that many of these communities are democratic strongholds, but many Republicans have been offended by this outrageous hunger for dictatorial power. Indeed many bipartisans cooperated to create this centrist diagrama and many are invested in the markets that are driven by this dogma of class corporatism on the march, but many escaped countries run by regimes of that order and recoil from the thought that such chaos could rule here in the land of the free.
We are on the precipice, standing on the edge of destruction, tempted by the rich and privileged to serve them by stepping over the edge of common sense and into the pit of our demise. Plain and simple those strutting fascists who claim to see the big picture envision a future after the pogrom and elimination of 5.5 billion of the world's population, as now a corporate elite of the rich and privileged can rule with its highly evolved technology and robotics - it no longer needs a large pool of workers to sustain this level of civilization. Old established lineages can be allowed to prevail and the bulk of the polluting population can be eliminated quickly in a great time of reaping. Genocide is in the air - theological and nationalistic movements are the targets and any other target of opportunity that can be the victim of inquisition. It will spin whatever yarn it chooses, targeting victims and inventing the headlines as it goes along.
The question you must ask yourself is "Will I be one of them?" "How can I be sure I won't be a victim in the gulag?"

Now John Ashcroft is asking Congress to pass even more violations of civil rights in the form of Patriot II. The following is some clarification on this repressive Act of fascistic inspiration.
Domestic Security Enhancement Act of 2003 (AKA PATRIOT II)
Provisions in the Attorney General’s bill would allow the government to strip citizenship from any American who provides support for a group designated by the federal government as a "terrorist organization" (section 501). Significantly, the USA PATRIOT Act broadened the definition of groups that could be so designated to potentially include domestic protest organizations such as Operation Rescue or People for the Ethical Treatment of Animals.
Also included are provisions permitting -- without court order and at the sole discretion of the Attorney General -- wiretapping of Americans for 15 days (sections 103, 104) without a declaration of war by Congress, if the Executive Branch decides unilaterally that an attack has created an emergency. While the Justice Department would have to check in with a judge after the 15 days
Other contentious proposals in the draft legislation include statutory authority for secret detentions and the termination of court-approved limits on police spying, because of the redefinition of domestic terrorism in USA PATRIOT, could sweep in protest tactics that "involve violent acts or acts dangerous to human life." Under the law, the ACLU said, if an anti-war protestor broke the law during a demonstration and someone died as a result, the protestor could be subject to the death penalty. (Section 411) the ACLU said. Specifically, the bill, if signed into law, would also:
Make it easier for the government to initiate surveillance and wiretapping of U.S. citizens under the shadowy, top-secret Foreign Intelligence Surveillance Court. (Sections 101, 102 and 107)
Shelter federal agents engaged in illegal surveillance without a court order from criminal prosecution if they are following orders of high Executive Branch officials. (Section 106)
Authorize, in statute, the Department of Justice’s campaign of secret detentions by including a provision that would preempt federal litigation challenging non-disclosure of basic information about detainees. (Section 201)
Threaten public health by severely restricting access to crucial information about environmental health risks posed by facilities that use dangerous chemicals. (Section 202)
Harm Americans’ ability to receive a fair trial by limiting defense attorneys from challenging the use of secret evidence. (Section 204)
Reduce the ability of grand jury witnesses in terrorism investigations to defend themselves against public accusations by gagging them from discussing their testimony with the media or the general public. (Section 206)
Allow for the sampling and cataloguing of innocent Americans’ genetic information without court order and without consent. (Sections 301-306)
Permit, without any connection to anti-terrorism efforts, sensitive personal information about U.S. citizens to be shared with local and state law enforcement. (Section 311)
Undercut trust between police departments and immigrant communities by opening sensitive visa files to local police for the enforcement of complex immigration laws. (Section 311)
Terminate court-approved limits on police spying, which were initially put in place to prevent McCarthy-style law enforcement persecution based on political or religious affiliation. (Section 312)
Provide an incentive for neighbor to spy on neighbor and pose problems similar to those inherent in Attorney General Ashcroft’s "Operation TIPS" by granting blanket immunity to businesses that phone in false terrorism tips, even if their actions are taken with reckless disregard for the truth. (Section 313)
Further criminalize association -- without any intent to commit acts of terrorism -- with unpopular organizations labeled as terrorist by our government. (Section 402)
Under the pretext of fighting terrorism, unfairly target undocumented workers with extended jail terms for common immigration offenses. (Section 502)
Provide for summary deportations without evidence of crime or criminal intent, even of lawful permanent residents, whom the Attorney General says are a threat to national security. (Section 503)
Abolish fair hearings for lawful permanent residents convicted of criminal offenses through an "expedited removal" procedure, and prevent any court from questioning the government’s unlawful actions by explicitly exempting these cases from habeas corpus. Congress has not exempted any person from habeas corpus -- a protection guaranteed by the Constitution -- since the Civil War. (Section 504)
VICTORY ACT
Ashcroft will be pushing for passage of the Victory Act which stands for the Vital Interdiction of Criminal Terrorist Organizations Act.
Senators Hatch (R-UT), Sessions (R-AL), Kyl (R-AZ), Graham (R-SC), and Cornryn (R-TX) have drafted the Vital Interdiction of Criminal Terrorist Organizations (VICTORY) Act. The legislation would make drug possession a terrorist offense and increases the threshold for rejecting illegal wiretaps.

The Patriot Act and the Patriot Act II, as well as the Victory Act
It breaks the political backs of the judiciary and legislative branches of government.
It allows random arrests and detention without hearings or trials for anyone or any group designated by the President.
It allows the concealment of Presidential records.
It permits secret "Military Tribunals" for presidentially-designated "terrorists".
It legalizes "sneak-n-peek" searches and seizures.
It allows the unlawful infiltration and surveillance of legal, domestic religious, labor and political organizations.
It allows the wholesale surveillance of private citizens, records and other materials without proof of probable cause.
It destroys all e-mail and internet privacy... get this my friend - here is the scene:
You score some smoke. Innocent little transgression? - not any more. Now the special police can come and wisk you away in full swat, put you on a plane declaring you a "stateless person" and as soon as the plane lands in a Coalition Country the local law immediately arrests you as a suspected terrorist, since you have no papers. At the behest of the local CIA their Israeli trained interrogators can put the thumb screws to you. You didn't even get to call your wife or kiss your kids. There was never any accusation, formal arrest and detainment, bail out and wait and then the instrument of justice proceeds and you pay to play as the lawyers rub their hands together. Not even a phone call and your friends just think you disappeared. Weeks later you turn up dead in a distant country assuming anyone gets to find out. Seems they filled out the paper work for you, filed it with the judge, got the conviction and executed you in advance just to make sure. This happened in Operation Condor in Chile during Allendes overthrow and the rise of Pinochet's CIA sponsored state genocide of the socialist leftist students. The US Government allowed US corporations to go in and assist in the political repression against many innocent dissidents and students, as well as innocent Americans caught in the crossfire. Henry Kissinger is wanted for human rights abuses there for his role in assisting the MaClarty Group in support of the Pinochet regime. Governor Richardson, governor of New Mexico and himself a democratic centrist, used to work for the McClarty Group around the same era - I have not verified at this time if he had any role in Chile. It is sufficiently significant that he did work for a Corporation which was cited for human rights violations at that time of employment and that he had the singular talent of speaking spanish. If he fulfilled a covert role with the CIA we will probably never know as the Official Secrets Act will keep us in the dark for as long as it takes our memory to die.
10,000 students were killed and floated down the rivers to terrorize the citizenry into not opposing the regime that had just deposed a popular president. They called them "the disappeared - los desaparecidos". Our leaders have decided to act opportunistically and with great guile targeting our most precious liberties and our most innocent transgression as a moralistic justification for mass victimization.
Each person that is disappeared out of the neighborhood only meets with whispered mutterings of an otherwise terrified citizenry cowering to not be the one destroyed. Only a madman could think this would be a moral lesson for Americans and an acceptable tactic. It is the hand of Terror and the embodiment of the Great Terrorist - the shadow government that will surely evolve out of this matrix of doubt and fear.
Replacing society and civics without a bloodbath will be impossible and the very government will be acting to promote the free fall of law and order as any of us has ever known it.
Only by imposing this upon our selves, suffering under the illusion that we could somehow profit by it ourselves and be spared, could we ever be called upon to witness such a time. Only if we chose to act with guile and wanton ignorance could we overthrow the great system of checks and balances that is the wisdom of our Bill of Rights and Constitution.
This is the most critical test of our times, because old jealous orders stand face to face in an OK Corral - Secular orders on one side and Pluralist orders on the other in a War for the Human Spirit. Do we have the collective courage to step into the Aquarian future and vision our own future for ourselves? Or do we need a guide. a scripted role and and a foregone conclusion that we are superior as a prophetic backdrop like a guarantee by the author of the very movie were in! When will we as a society ever get to these deeper considerations in our political conception of the world? We must rally at the local level at every level of our local and state government and eventually overwhelm the deviousness sown in a criminal Congress captive of the corporate culture and the rampant greed devouring the sane values of our great country. That is the way we can turn our government around and restore the people's will.
