Peoples Power vs. Larry Alba - Corporate vs. Personal Rights

The Monolith of Corporate Power is an imposing force in the world today as individuals are overwhelmed by the weight of money and greed. The advent of Peoples Power seemed innocent enough, but larger matrices of the power cosmology have emerged revealing an even more insidious hegemony of stable sector utilities that have the appetites of pirahna for the people's rate-paying monies. Enter First Power, enter Peoples Power, and a host of other's like Bank of America. And at the top it's called ENERTECH and it's all troughthed in the BALLANTINE FUND.

BUT IT'S STILL A DOG AND PONY SHOW FOR THE PUBLIC'S BENEFIT WHILE "THE BEST CONGRESS MONEY" CAN BUY SITS DOWN TO MERRILY WRITE LEGISLATION WHICH WILL ALLOW THEM TO MANDATE COMPLIANCE WITH ALL ASPECTS OF THE LEGISLATION, OVERRIDING ANY STATE LEVEL IMPEDIMENTS UNDER THE MANTLE OF FEDERAL POWER AND JURISDICTION, THEREBY OVERTURNING ANY LOWER COURT.
This is end result of corporate power run amuck, a clear subversion of the process to the will of a business entity, over the rights of a common citizen.
Larry Alba, 'the little man from California'. as Herman Tabet characterized him, has turned out to be a tough customer for the County of Valencia in New Mexico; and, if he wins and the fat lady signs the county will no doubt be paying the bill.
All this because of what looks like collusion between two county employees who conspired. with a swash of a red pencil. to make an illegal change on a zoning map. No one has even tested these two to see if they are colorblind and thought they were using a green one instead. Just think, it could all be just an innocent mistake. Wrong! County Governments don't move like that. They act in a very concerted fashion on anything they do, because to fly their legislation has to pass a majority muster. None of these Commissioners can rightfully claim he didn't know what was going on in that universe.
"Little Big Man" - Larry Alba deserves everybody's support. All of the County and corporate players knew exactly what they were doing all the way to the Supreme Court, including Tom Garde, County attorney, Mc Clarty and Suedeen Kelley, recent fast track appointee to the Federal Energy Resources Committe or FERC - just watch the Federal facilitation that takes place here. What the politicians think is that we can't possibly know or understand the requisites and facets of the issues and that's why we elect their superior knowledge to legislate for us.
We, the common citizens, are presumed to be just not bright enough to understand the truth or even when we are being duped by the gouger and the foiler, while the Public Trust is sacked, they just facilitate further doom. Each degenerative step they extol as progress! The Energy Monster is Terrorizing the Nation and you, our beloved consumer-inmate, you must save the day by enslaving yourself to the NEW IMPROVED GRID of RATEPAYERS until the end of your days!
Just as the Military Industrial Sector had to be fed with the blood sacrifice of the Nation of Iraq, so too now in the larger scenario of Energy DOOM if we don't sell our souls to remantle the GRID we'll surely be swept asunder. The latest "terror driven" imperative is the fear that someone could pull the plug on you BY NOT HAVING ENOUGH and making a big brown out for everybody. ENERGY GODS FORBID!
So, MR. RATE PAYER, get ready to have MANDATORY ENERGY LAWS IN AMERICA - THOU SHALT CONSUME FOSSIL FUELS! In fact, if there is to be energy reform and the emergence of co-generative processes such as HYDROGEN they ( Enertech, the Government and I am quite sure our fearless leader himself somewhere in that money mix) plan to mandate that Hydrogen technology be forced to use natural gas distribution as a primary source of Hydrogen extraction for use in Hydrogen driven systems. Another energy hydrogen-tech company is PLUG POWER and they make home hydrogen units, but they have to extract it from Natural Gas pipelines, thus feeding the petro-porkers.
Whatever happened to seawater? Why do we have to guarantee and irrevocable steady stream of petrochemicals as a precursor to a cleaner energy source? We create an industry with more rights over the market than others who would champion newer and cleaner technology. And we also let them wield a wide swath with power of imminent domain to be levied against the innocent and unsuspecting rate payer who will have to pay a disproportionate cost to this indentured slavery and extortion.
Larry Alba is just such a case and, as a Bill of Rights Advocate, my heart goes out to this victim of such facilitators. This is representation for the consumer-inmate of the 21st century.
I enclose a letter to Pete Domenici. Senator (R) from New Mexico which Larry wrote to explain his position and I urge all citizens to implore Senator Domenici to not violate Larry's Property Rights in the interest of any larger corporate facilitation over and above the Public's Mandate and that has been clearly demonstrated by the overwhelming majority sentiment within the community against the Power Plant in Valencia County at Rio Communities.

Dear Senator Domenici,
I am an owner of over 400 home site properties in the Rio Grande Estates, New Mexico. I am the Plaintiff in a case regarding Conflicts and Errors in the Zoning of the proposed location of a Natural Gas Burning Power Plant. Hundreds of residents also oppose this Plant by signing a petition and appearing at the Public Hearings. Because you are a member on the Energy and Natural Resources Committee, I am writing to you regarding the recent nomination of Suedeen Kelly from New Mexico by President George Bush to fill the seat on the Federal Energy Regulatory Commission (FERC). My request is that you oppose this nomination. I am Very Concerned what an “Inappropriate Nomination” Suedeen Kelly is because she obviously has been “extremely dishonest numerous times” to Judge William Sanchez (see transcript attachment) at the March 21, 2003, Court Hearing at the 13th Judicial District Court in Los Lunas, New Mexico, to stop the building of a gas burning power plant. She said that the proposed power plant “…only emits Water Vapor and (CO2) into the air…” Suedeen Kelly is one of the attorneys who represent the People’s Energy Resources Corporation, aka Valencia Energy LLC, that applied for an Air Quality Permit in 2001 with the New Mexico Environmental Department to obtain a permit for 861 Tons per year of Deadly Pollution from this Power Plant such as: Carbon Monoxide, Sulfur Dioxide, Nitrogen Oxides, Particulate Matter, Volatile Organic Compounds, Formaldehyde. That is 1,722,000 Pounds. She also led a team of attorneys promoting the building of this power plant and discussing all of the pollution levels involved at the Air Quality Bureau Hearing held April 8, 2002. The Environment Department issued a permit on July 18, 2002. I make reference to the attached Court Reporter’s Transcript, pages 28-29, 35 & 41.
I’m also attaching the Two Certified Letters that I received from the Modrall Law Firm, in which Suedeen Kelly practices, to notify me as a nearby landowner of an intention by Valencia Energy, LLC to build this power plant. This proposed power plant site is only 86 feet away from the Rio Grande Estates subdivision where my home site properties are located. At the March 21, 2003, Court Hearing, Suedeen Kelly pleaded with Judge Sanchez “…to allow an oil processing plant like Mesa Environmental in this industrial park but not a facility that processes natural gas and only emits water vapor and CO2 into the air, a harmless substance, would be an absurd result…It is clean…” (See attached: “Air Quality Permit for Combusting of Pipeline Natural Gas in Combustion Turbines (CTs)” I am arguing that this is not a Gas Processing Facility. Please note that I reported this matter on March 28, 2003, by calling a message to President George Bush and e-mailed him as well. This e-mail was copied and faxed to Senator Jeff Bingaman and all of your offices Senator Domenici. FBI Agent Dick Robles personally appeared to pick up the entire Court Transcript of the March 21, 2003, hearing to assist them in the FBI Investigation of Suedeen Kelly’s appointment. At the March 21, 2003, hearing, I made objections to Suedeen Kelly’s dishonest statements to Judge Sanchez. He then granted me a Court Order that would stop the building of the power plant because it is “not listed as a permitted use” under Valencia County Comprehensive Zoning Ordinance. I am also attaching the confirmation card to prove that I have filed my formal complaint to the New Mexico Disciplinary Board of the Supreme Court, regarding Suedeen Kelly’s deception in court on my case to stop the building of this power plant.
Please VOTE "NO" on the nomination of Suedeen Kelly to be on the Federal Energy Regulatory Commission at the hearing to be held on September 9, 2003. She will be a disservice to the people of the United States of America. This is my second letter to you, the first which was May 21, 2003. I will call you soon to confirm that you have received this urgent letter. I look forward to speaking with you for approximately five minutes, please. Thank you very much for your time and prompt attention in addressing my letters and concerns regarding this matter, not only for me but also for the people of Valencia County, New Mexico. Hence, if she is appointed to the FERC, and her deception continues not addressed, then this can and will have a negative impact on us and effect the people throughout this country regarding energy related issues.
